Terms of service

1. Scope

These terms apply to every contract between us and you for use of the Clipfunk web application. Different user terms do not apply. A consumer is a natural person entering into a transaction mainly outside their trade, business or self-employed profession under Section 13 BGB.

2. Service

Clipfunk monitors public Twitch streams, automatically identifies notable moments from chat and audio signals and creates vertical 9:16 video clips with captions, title suggestions and social copy. Users can review, approve and download clips in the dashboard, edit them in the integrated studio and, after connecting their own YouTube account, upload them to their own channel.

Detection is automated and signal-based. Whether clips are created and how many depends on events in the monitored stream, including chat activity, audio and broadcast time. There is no entitlement to a particular number or quality of clips; the daily allowances in Section 3 are maximum limits, not promises.

3. Plans, allowances and limits

We offer one free and two paid plans:

• Free (€0): up to 4 watermarked clips per day and up to 3 monitored channels.
• Premium (€24.99 per month or €249.99 per year): up to 10 clips per day without a watermark and up to 10 monitored channels.
• Ultra (€49.99 per month or €499.99 per year): up to 50 clips per day without a watermark and up to 50 monitored channels.

Subscriptions are available monthly or annually. Annual prices equal ten monthly payments. Subscriptions renew for the selected term unless cancelled before it ends.

You can also buy ten additional clips for a one-time €5.00. They do not expire daily and are used after the daily allowance. If every eligible user’s allowance for a channel is exhausted, clip creation pauses until the next UTC day. To prevent abuse, unfollowing a channel is limited per calendar month to 1 on Free, 3 on Premium and 10 on Ultra. All prices are final euro prices. No VAT is charged or shown under Section 19 UStG.

Clip retention: Clips are stored for 48 hours after creation and can be downloaded during that time; Ultra stores clips for one week. The dashboard displays a countdown before expiry. Retention can be extended once by 24 hours per clip to allow download. Video files are deleted permanently and automatically after expiry; the catalogue entry and preview may remain as evidence. There is no entitlement to longer storage. Users are responsible for backing up clips, and deleted video files cannot be recovered.

4. Forming the contract

The Free contract begins when registration is completed. Paid plans and top-ups are purchased through Stripe; the contract begins when the payment process is completed by clicking the relevant purchase or subscription control at Stripe. The contract language is German.

5. Term, cancellation and plan changes

Paid plans run for one month and renew automatically for another month unless cancelled before the billing period ends. You may cancel at any time for the end of the current billing period in the dashboard under Account → Manage subscription, which opens the Stripe portal, or by emailing info@pixylmedia.com. After a paid plan ends, the account moves to Free automatically and existing clips remain. Upgrades take effect immediately; Stripe charges proportionally or at the next billing date. Our right to terminate for cause remains unaffected.

6. Consumer right of withdrawal

Consumers have the following right of withdrawal for paid plans and top-ups.

Withdrawal notice

Right of withdrawal. You may withdraw from this contract within fourteen days without giving a reason. The period begins on the day the contract is made. To exercise this right, inform us clearly, for example by email, at Pixylmedia, Batuhan Tasci, Neufeldstraße 20a, 76187 Karlsruhe, info@pixylmedia.com. You may use the model form below, but it is not required. Sending the notice before the period ends is sufficient.

Effects of withdrawal. If you withdraw, we will reimburse all payments received from you without undue delay and no later than fourteen days after receiving your notice. We use the same payment method as the original transaction unless agreed otherwise, with no reimbursement fees. If you requested that the service begin during the withdrawal period, you must pay a reasonable amount corresponding to the proportion already delivered compared with the full contracted service.

Expiry of the right. For one-time clip top-ups, the right of withdrawal expires once we have fully performed the service, provided performance began only after your express consent and confirmation that full performance ends your right of withdrawal.

7. User obligations, content and rights

• You may connect a Twitch channel as “your own channel” only if you own it.
• When monitoring other channels as a clipper or publishing clips, you are responsible for having the necessary content rights and following the streamer’s rules and platform terms, particularly Twitch and YouTube terms. Clipfunk provides tools but does not assess the legal status of individual content.
• YouTube uploads go only to your own connected account and at your direction. Automatic posting is disabled by default.
• Abuse, including evading allowances or limits, manipulation of detection and unlawful use are prohibited. We may suspend or terminate accounts after warning, or immediately for serious violations.

8. Availability and service changes

We provide the service with reasonable care but do not promise uninterrupted availability. Maintenance, development and failures at third parties such as Twitch, YouTube, payment or hosting providers may temporarily limit use. We may develop and change features as long as the contract’s purpose remains available to you; Section 327r BGB remains unaffected.

9. Warranty and liability

Statutory warranty rights for digital products under Sections 327 et seq. BGB apply. Liability is unlimited for intent, gross negligence and injury to life, body or health. For ordinary negligence, we are liable only for breach of essential contractual duties whose performance enables proper execution of the contract and on which you may regularly rely, limited to the foreseeable loss typical of the contract. Liability under the Product Liability Act remains unaffected.

10. Changes to these terms

We may change these terms for the future where compelling reasons such as legal changes or new features require it and the change does not unreasonably disadvantage you. We will notify you by email or in the dashboard at least four weeks before a change takes effect. If you do not object by that date, the amended terms are deemed accepted; the notice will explain this separately. If you object, either party may end the contract when the change takes effect.

11. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice applies only insofar as it does not remove mandatory protection under the law of their usual country of residence. We are neither willing nor obliged to participate in consumer arbitration proceedings. The European Commission platform is available at ec.europa.eu/consumers/odr. If individual provisions are invalid, the remaining provisions remain effective.
